We at GenOpp Capital Management LP and its affiliates (together “GenOpp,” “our,” “us,” “we,” and any other similar terms used throughout) know you care about how your personal information is used and shared, and we take your privacy seriously. This Privacy Policy covers our treatment of personally identifiable information (“Personal Information”) that we gather when you are accessing or using www.gen-opp.com (the “Website”). By using or accessing the Website in any manner, you acknowledge that you accept the practices and policies outlined in this Privacy Policy.

This Privacy Policy does not apply to information that you provide or we otherwise collect through other means than the Website. For example, if you are an Investor, your provision of information to GenOpp offline is not subject to this Privacy Policy but may be subject to the Governing Agreement or another binding agreement between you and GenOpp (as defined in the legal terms ). In addition, if you are an Investor and you access the Investor portal through a link on our Website, please note that the portal is separate website hosted by a third party and your access to and use of the Investor portal is subject to the Legal Terms and privacy policy of that third party website.

Remember that your use of the Website is at all times subject to the Legal Terms, which incorporates this Privacy Policy. Any terms we use in this Policy without defining them have the definitions given to them in the Legal Terms.

What Information does GenOpp Collect?

Information You Provide to Us:

The Website does not require you to disclose any information to us. However, you may decide to voluntarily provide Personal Information to us through the Website. We may communicate with you if you’ve provided us with the means to do so. For example, if you’ve given us your email address, we may send you informational emails on behalf of GenOpp. If you do not want to receive communications from us, please indicate your preference by sending an email to  ir@gen-opp.com.

Information Collected Automatically

Whenever you interact with our Website, we automatically receive and record information on our server logs from your browser or device, which may include your IP address, “cookie” information, the type of browser and/or device you’re using to access our Website, and the page or feature you requested. “Cookies” are identifiers we transfer to your browser or device that allow us to recognize your browser or device and tell us how and when pages and features in our Website are visited and by how many people. Will GenOpp Share Any of the Personal Information it Receives?

GenOpp will not share Personal Information with any third party for commercial purposes. GenOpp may, however, disclose Personal Information if (1) it is reasonably necessary to provide the Website and Content (as defined in the Terms), such as to third-party service providers who help GenOpp provide the Website, (2) it has been authorized by you, (3) it is required to do so by law or (4) it has a good faith belief that such action is necessary to conform to applicable laws or comply with any legal, regulatory or similar requirement or investigation, to protect or defend the rights or property of GenOpp or another user or to enforce our Terms.

In addition, we may choose to buy or sell assets, and may share and/or transfer customer information in connection with the evaluation of and entry into such transactions. Also, if we (or our assets) are acquired, or if we go out of business, enter bankruptcy, or go through some other change or control, Personal Information could be one of the assets transferred to or acquired by a third party.

Is Personal Information about me secure?

We endeavor to protect the privacy of your account and other Personal Information we hold in our records, but unfortunately, we cannot guarantee complete security. Unauthorized entry or use, hardware or software failure, and other factors, may compromise the security of user information at any time.

When you update information, however, we may maintain a copy of the unrevised information in our records. We may use any aggregated data derived from or incorporating your Personal Information, but not in a manner that would identify you personally.

Changes to Policy; Questions

GenOpp reserves the right to change or update this Privacy Policy at any time by posting the revised Privacy Policy to the Website. In some cases (for example, if we significantly expand our use or sharing of your Personal Information), we may also tell you about changes by additional means, such as by sending an e-mail to the e-mail address we have on file for you.  In some cases, we may request your consent to the changes. Your continued use of the Website following the posting of any changes to this Privacy Policy constitutes acceptance of those changes.
